Terms of Service

1. Acceptance of Terms
By creating an account or using BulaLease ("the Platform"), you agree to these Terms of Service. If you do not agree, do not use the Platform. BulaLease is operated by Ubitec System Solutions and is intended for use within the Republic of Fiji.
2. Eligibility
You must be at least 18 years of age and legally able to enter into a binding contract under Fiji law to use BulaLease. By using the Platform you represent that you meet these requirements.
3. Landlord Responsibilities
Landlords using BulaLease agree to:
- Provide accurate property information, including correct addresses and rental amounts.
- Comply with all applicable Fiji laws, including the Landlord and Tenant Act, iTaukei Land Act, and any relevant municipal by-laws.
- Not list properties for purposes other than legitimate residential or commercial rental.
- Maintain current lease agreements and payment records.
4. Tenant Responsibilities
Tenants using BulaLease agree to:
- Provide accurate personal information during registration and lease signing.
- Submit rent payments and maintenance requests through the Platform in good faith.
- Not share account credentials with third parties.
5. Prohibited Content
You must not use BulaLease to list, advertise, promote, or facilitate the sale or distribution of illegal goods or substances, including but not limited to controlled drugs under Fiji's Illicit Drugs Control Act 2004. Violations will result in immediate account termination and may be reported to the Fiji Police Force.
BulaLease uses automated content screening on all listing submissions. Listings containing prohibited content will be rejected and not published.
6. Platform Use & Restrictions
You agree not to:
- Attempt to access another user's account or data.
- Reverse engineer, scrape, or extract data from the Platform.
- Use automated scripts to submit forms or generate listings.
- Misrepresent your identity or property ownership.
7. Payments & Subscriptions
BulaLease offers a free tier and paid plans. Paid plans are activated manually upon receipt of payment via BSP, ANZ, or Westpac bank transfer. Subscription fees are non-refundable except where required by Fiji law. BulaLease is not a payment processor and does not hold tenant rent funds — all payments are made directly between landlords and tenants.
8. Digital Signatures
Electronic signatures captured through BulaLease's inspection and lease signing tools are legally binding under Fiji's Electronic Transactions Act 2017, provided that both parties have consented and the consent is recorded. BulaLease stores consent timestamps for all digital signatures.
9. Limitation of Liability
BulaLease is a software platform, not a licensed real estate agency or legal advisor. We are not responsible for disputes between landlords and tenants, lease enforceability, or the accuracy of rental market data. Use of the Platform does not constitute legal or financial advice.
10. Account Termination
We reserve the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or poses a risk to other users or the Platform. Users may close their account at any time by contacting sales@bulalease.com.
11. Changes to Terms
We may update these Terms from time to time. Continued use of BulaLease after changes are published constitutes acceptance of the updated Terms. Material changes will be notified by email.
12. Governing Law
These Terms are governed by the laws of the Republic of Fiji. Any disputes shall be subject to the exclusive jurisdiction of the courts of Fiji.
